What is probate?
The legal definition of probate is the action or process
of proving before a competent judicial authority that a document offered for
official recognition and registration as the last will and testament of a
deceased person is genuine.
In layman’s terms, it is the legal process of settling the estate of a deceased person, also known as the decedent. Essentially, the probate court will supervise the process ensuring that all of the decedent’s debts are satisfied, all claims surrounding the estate are resolved, and that the remainder of the decedent’s property is distributed according to the instructions left in the will and the laws of the state.
Usually, the will names a personal representative or an executor to the estate. If there is no will (the decedent dies intestate) then the court will appoint someone to this position. The executor’s job is to carry out the decedent’s instructions as laid out in the will.
After opening the probate case with the court, the personal representative’s first task is to take inventory of the decedent’s property—both real and personal—and lastly, to collect that property. This means that all the property previously owned by the decedent, furniture, stocks, bonds, real estate, cars, etc. must be accounted for by the executor and then entered into probate.
Next, the executor will satisfy any outstanding debts tied to the estate, including property taxes, court fees, and probate attorney fees.
The last thing that the personal representative must do is distribute the remaining assets amongst the heirs to the estate. Again, either this is done as intended by the will or, if there is no will, per the intestacy laws of the state.
